From Today, 260,000 affected Toyota Australia motorists can register their interest to receive compensation following a federal court ruling from earlier this year.
In April 2022, the Australian Federal Court found the Toyota Hilux, Toyota Prado and the Toyota Fortuner diesel vehicles that were sold between the dates of October 2015 to April 2022 had a major defect with the diesel particulate filters. The court found the automotive giant, Toyota Australia had “engaged in misleading or deceptive conduct while marketing and selling the cars”.
The defect, found that the diesel particulate filters, caused white smoke and foul-smelling exhaust to be excessively emitted, whilst increasing total fuel consumption.
All affected owners will be contacted directly to sign-up to receive thousand of dollars in compensation as part of the $2 billion settlement. However, it is understood that Toyota Australia has proceeded with contesting the ruling and the money involved.
Owners of the affected vehicles must register their details with the assigned firm to be eligible for any compensation payments. Owners must understand that if Toyota Australia’s appeal succeeds, they may not be offered any compensation payments.
There is no cost for affected owners to register their interest. If Toyota is successful in their appeal no registered motorist will be charged.
The court awarded compensation to each affected motorist at the estimated rate of 17.5% of the cars value. In dollar figures this equates to between $8000 and $15,000 in compensation depending on the vehicle type.
A total of 264,170 Toyota Vehicles are affected and included with either the 2.8 Litre (1GD-FTV) or the 2.4 Litre (2GD-FTV) turbo diesel engines with faulty diesel particulate filters.
Motorists who purchased a Toyota Hilux, Toyota Prado, or Toyota Fortuner Diesel between the dates of October 1st, 2015, to April 30th, 2020, are eligible to register for compensation.
Affected owners will be contacted directly by the assigned legal firm who are dealing with the matter in the federal court. If you are yet to receive a response you can apply directly on the official website page here.
No timeframe has been given at this stage. Toyota Australia are currently appealing the decision.
The Federal Court has awarded a compensation rate of 17.5% of the vehicles purchase price. An estimated financial number is between $8,000 and $15,000 per vehicle, depending on model type and purchase price.
The appeal process is yet to formally begin. The appeal process can take several months. Updates will be provided in due course.
